TERMS OF SERVICE, WEBSITE USE AND MEMBERSHIP AGREEMENT

This Agreement sets out the terms and conditions relating to the use of the Website, membership, order processing and users’ activities on the Website.

2. Acceptance of the Agreement

By creating a membership account on the Website, the User declares that they have read and accepted this Agreement.

Acceptance of the Agreement is completed when the User actively ticks the relevant checkbox during registration.

The User is required to provide accurate and up-to-date information when creating a membership account, placing orders and using the Website.

3. Scope of Services, Use of the Website and Membership

www.decobritish.com is a website where users can browse and purchase vintage, antique, retro, collectible and other ceramic and porcelain products. Users can access product information, place orders and communicate with Decobritish through the Website.

Users must be at least 18 years old to create a membership account and use the Website.

Users must not:

• Provide false, misleading or inaccurate information.
• Use the Website for unlawful purposes.
• Use the Website in a manner that disrupts public order, violates public morality, disturbs or harasses others, or infringes the intellectual property rights of others.
• Attempt to gain unauthorised access to the Website, customer accounts or systems.
• Interfere with the operation, security or proper functioning of the Website.
• Misuse the ordering, payment, return or complaint processes.
• Use the Website in a manner that infringes the rights of Decobritish or third parties.
• Comply with all applicable laws and regulations when using the Website.

The User is responsible, in accordance with applicable law, for unlawful conduct and for any damage for which the User is directly responsible as a result of such conduct.

The User’s liability for any damage suffered by Decobritish as a result of the User providing incorrect or incomplete information or breaching this Agreement shall be assessed in accordance with applicable law.

The User is responsible for their own statements, comments and content shared while using the Website. Any liability arising from comments or statements made by third parties shall be assessed in light of the circumstances of the case and applicable law.

4. Account Creation and Security

A customer account may be required to access certain services on the Website.

The User agrees to provide accurate information when creating an account and to update that information when necessary.

The User is responsible for maintaining the confidentiality of their account details and for transactions carried out through their account. If the User suspects unauthorised access to their account, they must contact Decobritish without delay.

Usernames and passwords must not be transferred to or used by other people. The User must take the necessary measures to protect their account details.

In the event of account misuse, unauthorised access or a breach of this Agreement, Decobritish may take necessary and proportionate security measures. These measures may include temporarily restricting the account or blocking access.

5. Product Information and the Condition of Vintage or Antique Products

Decobritish sells vintage, antique, collectible and other ceramic and porcelain products. Products may differ in appearance and condition due to their age, manufacturing characteristics, storage conditions or previous use.

Vintage and antique products may show age-related colour variations, fading, signs of previous use, minor scratches, small chips or breaks, surface marks and other age-related imperfections. These characteristics and any known material defects that can reasonably be identified will be described in the product listing and shown in the available photographs or videos.

Customers should carefully review the description and photographs or videos of the relevant product before placing an order.

By placing an order, the Customer declares that they have reviewed the description and photographs or videos of the relevant product, including the condition information disclosed before purchase, and accepts the condition and visible characteristics of the product as previously disclosed.

This acceptance is limited to the condition and visible characteristics disclosed before purchase.

Measurements, colours and other product information are presented as accurately as reasonably possible. Minor variations may occur due to lighting, photography, screen settings or the individual characteristics of vintage and antique products.

6. Orders, Prices, Payments and Promotions

All orders are subject to product availability and acceptance by Decobritish.

Before completing a purchase, the Customer is responsible for checking the product information, quantity, price, delivery details and other information relating to the order.

Prices and delivery charges are displayed on the Website or communicated to the Customer during the ordering process, where applicable.

Payments are made using the payment methods offered during checkout.

An order confirmation indicates that the order has been received; it does not necessarily mean that the order has been finally accepted or dispatched.

If a product is unavailable, a material error is identified in the listing or price information, or the order cannot reasonably be fulfilled, Decobritish may contact the Customer or cancel the order.

If payment has been received for an order cancelled by Decobritish, the amount relating to the cancelled order will be refunded without delay.

Promotions, discounts and special offers published on the Website are subject to the conditions specified for the relevant promotion. Unless otherwise stated, promotions are subject to stock availability.

Decobritish reserves the right to amend promotional conditions or end a promotion. Such changes will not retrospectively remove rights relating to orders that have already been completed.

Typographical, technical or system-related errors may occur in product descriptions, prices or other information on the Website. Decobritish reserves the right to correct such errors. If an order cannot be fulfilled due to an error, the Customer may be contacted or the order may be cancelled. If payment has been taken, the relevant amount will be refunded without delay.

7. Order Cancellation and Refusal of Service

Decobritish may refuse or cancel an order where a product is unavailable, there is an obvious pricing or listing error, fraud is suspected, the Website is misused, this Agreement is materially breached, or another legitimate legal or operational reason exists.

Decobritish may also refuse to accept future orders from a particular Customer where reasonable grounds exist, including proven fraud, repeated misuse of return or complaint procedures, abusive conduct towards employees, or a material breach of this Agreement.

Such decisions will be made in accordance with applicable law.

8. Delivery and Receipt of Products

Estimated delivery times are provided in good faith; however, they may be affected by circumstances beyond Decobritish’s reasonable control, including delays by courier companies, customs procedures and other transportation issues.

The Customer should inspect the parcel as soon as possible after delivery. If damage is identified to the parcel or product that may have occurred during transit, the parcel, shipping label, internal packaging and product must be retained for the assessment process.

9. Mandatory Unboxing Video for Return and Damage Claims

To submit a return request or a claim concerning damage to a product during delivery, the Customer must provide a video recording that continuously shows the parcel being opened.

The video must clearly show the following:

• The shipping label or barcode.
• The external condition of the parcel before it is opened.
• The process of opening the parcel.
• The internal packaging and protective materials.
• The moment the product is first removed from the packaging or becomes visible.

The video must show the parcel and its contents throughout the opening process and must not contain interruptions or edits that prevent the sequence of events from being assessed.

The Customer must submit the return or damage claim together with the unboxing video. Applications submitted without the required video may not meet the stated evidence requirement and may not be processed as complete claims.

Decobritish may request additional photographs, information or supporting evidence where necessary to assess the claim.

The Customer must retain the original packaging, shipping label and product until the claim has been assessed and the necessary instructions have been provided.

10. Verification of Returned Products

Any product returned to Decobritish must be the same product that was sent to the Customer as part of the relevant order.

For the purpose of assessing a return, Decobritish may compare the returned product with the original order information, product photographs, recorded measurements, identifying marks, condition information, packaging and dispatch records.

Decobritish may request additional information or evidence where clarification is required regarding the identity or condition of the returned product.

Returns must be made in accordance with the applicable Returns Policy and the relevant instructions provided by Decobritish.

11. Returns, Exchanges and Refunds

Returns, product exchanges, withdrawal requests and refunds are handled in accordance with the Returns Policy published separately on the Website and, where applicable, the Distance Sales Agreement.

Customers should consult these documents for the applicable procedures, deadlines, conditions and refund arrangements.

No provision of this Agreement shall be interpreted as intended to remove consumer rights that cannot legally be excluded.

12. Intellectual Property Rights and Content Sharing

The Website and its content, including text, product descriptions, photographs, videos, graphics, logos, branding elements and design, belong to Decobritish or are used with the necessary permissions, and are protected under applicable intellectual property laws.

Except where permitted by law, Users may not use the Website’s content for commercial purposes, modify it or otherwise make it available for use without prior written permission.

When sharing products or Website content for personal or promotional purposes, the source must be identified and any relevant copyright, trademark or other intellectual property notices must not be removed. Such shares must clearly identify Decobritish LTD or include the address www.decobritish.com.

This permission to share content does not constitute a general licence to modify the content, use it in a misleading manner or engage in any other use requiring Decobritish’s written permission.

The purchase of a product does not transfer to the Customer any intellectual property rights in the listing, photographs, description or branding associated with that product.

13. User Comments and Content

Users must comply with applicable law, respect the rights of others and follow general standards of conduct when posting comments or other content on the Website.

Content that is unlawful, misleading, harassing, threatening, infringes the rights of others or adversely affects the operation of the Website must not be published.

Responsibility for content shared by Users, including any infringement of third-party rights caused by that content, rests with the relevant User in accordance with applicable law.

Where necessary, Decobritish may review, remove or prevent the publication of comments or other content. Depending on the nature of the infringement, Decobritish may restrict access to the relevant account, implement technical blocking measures or pursue legal remedies.

14. Website Availability, Security and External Links

Decobritish takes reasonable measures to operate the Website securely and to handle orders and customer requests appropriately.

Decobritish may take proportionate measures to protect the Website and its business against fraud, misuse and unlawful activities.

Changes will not retrospectively remove rights that customers have already acquired.

This Agreement is governed by the laws of England and Wales. The courts of London shall have jurisdiction over disputes arising out of or in connection with this Agreement. By creating a membership account, the User declares that they have read and accepted this Agreement.
