DISTANCE SALES AGREEMENT
1. PARTIES
Seller
Buyer
2. SUBJECT OF THE AGREEMENT
This Agreement sets out the terms governing the sale and delivery of products ordered by the Buyer through the Seller's website and the rights and obligations of both parties.
3. FORMATION OF THE AGREEMENT
By completing an order, the Buyer confirms that they have reviewed the product information, price, payment details and other information presented during the ordering process.
The Agreement is formed when the order is accepted by the Seller. Order details and confirmation may be provided electronically.
4. PRODUCT DESCRIPTION AND CONDITION
The main characteristics of each product, its images, price and any stated condition details are provided on the relevant product page.
Vintage, antique, second-hand and collectible items may show age-related characteristics, variations in finish or signs of previous use.
5. PRICE AND PAYMENT
The price payable is the price displayed to the Buyer during the ordering process. The total amount payable is shown before the order is submitted.
Payment is processed using the payment methods made available on the website.
6. DELIVERY
Products are delivered to the address provided by the Buyer at checkout.
The Buyer is responsible for providing accurate and complete delivery and contact details. Delivery issues arising from incorrect or incomplete information will be assessed in accordance with applicable law.
The Seller shall not be liable for delays directly caused by circumstances beyond the Seller's reasonable control, including serious transport disruption, carrier incidents, natural disasters or public-authority restrictions. This provision does not exclude any liability or remedy that cannot lawfully be excluded under applicable consumer law.
7. RIGHT TO CANCEL
Where the Buyer is a consumer purchasing online, the Buyer will generally have the right to cancel the contract within 14 days beginning on the day after the goods come into the physical possession of the Buyer or a person identified by the Buyer to receive them, subject to applicable statutory exceptions.
The Buyer does not need to provide a reason for exercising this right. To cancel, the Buyer must inform the Seller of their decision by a clear statement, such as an email or letter, within the cancellation period. The Buyer is not required to use a particular cancellation form.
Where an order contains multiple goods delivered separately, the applicable cancellation period is calculated in accordance with the relevant consumer legislation.
8. RETURNS AND REFUNDS
The Buyer should contact the Seller before returning goods so that the return can be coordinated.
Following cancellation, the Buyer must send the goods back or hand them over as required by applicable law, without undue delay and no later than 14 days after informing the Seller of the cancellation.
The Buyer may be responsible for the direct cost of returning goods where the Seller has properly informed the Buyer of this before the contract was made. Where the Seller has agreed to bear return costs or applicable law requires the Seller to do so, the relevant costs will be borne by the Seller.
The Seller will reimburse payments in accordance with applicable law, including the cost of standard delivery where required. Any additional delivery charge resulting from the Buyer choosing a more expensive delivery option may be excluded from the refund to the extent permitted by law.
Where the law permits, the Seller may deduct an amount reflecting any reduction in the value of the goods caused by handling beyond what is necessary to establish their nature, characteristics and functioning.
9. DAMAGED GOODS AND PHOTOGRAPHIC/VIDEO EVIDENCE
If the Buyer receives goods that appear damaged, broken, incomplete or incorrect, the Buyer should contact the Seller as soon as reasonably possible and provide details of the issue.
The Buyer is encouraged to provide clear photographs or a video showing:
- The sealed outer package and shipping label before opening, where available.
- The condition of the outer packaging and any visible damage.
- The inside of the package and the protective packaging.
- The product and any damage, missing items or incorrect goods.
A continuous, unedited unboxing video is helpful evidence, particularly for damage, breakage, missing-item or incorrect-item claims. The Seller may also request additional photographs, video footage or other relevant information to investigate the issue.
The Buyer should retain the product and packaging where reasonably possible until the claim has been reviewed and should package any returned goods carefully to prevent further damage during transit.
The absence of photographs or video does not, by itself, remove or invalidate any statutory cancellation right or other consumer rights. Evidence requests and claims will be assessed in accordance with applicable consumer law.
10. GOODS CONFORMITY AND SELLER RESPONSIBILITY
The Seller is responsible for supplying goods that conform to the contract and applicable consumer law.
Where goods are faulty, not as described or otherwise fail to meet the applicable legal requirements, the Buyer may have statutory rights and remedies under the Consumer Rights Act 2015 and other applicable legislation.
Nothing in this Agreement excludes or limits any liability or consumer right that cannot lawfully be excluded or limited.
11. PRIVACY AND PERSONAL DATA
The Buyer's personal data will be processed in accordance with the Seller's Privacy Policy and applicable data protection legislation.
Information may be shared with relevant service providers where necessary to process orders and payments, arrange delivery, provide customer support or comply with legal obligations.
12. EVENTS BEYOND REASONABLE CONTROL
Neither party shall be treated as being in breach to the extent that performance is prevented or delayed by an event beyond that party's reasonable control.
The affected party shall take reasonable steps to reduce the impact of the event and resume performance where reasonably possible. Any statutory consumer rights and remedies that apply to the circumstances remain unaffected.
13. GOVERNING LAW AND JURISDICTION
This Agreement is governed by the laws of England and Wales and shall be interpreted in accordance with those laws.
The courts of England and Wales shall have jurisdiction over disputes arising out of or in connection with this Agreement, subject to any mandatory consumer protections and jurisdictional rights applicable to the Buyer.
